FishScore Terms & Conditions

1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern your access to and use of the FishScore mobile application and related services (collectively, the “App”), operated by AiAngler Tek, Inc. (“AiAngler,” “FishScore,” “we,” “us,” or “our”).

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

3. Eligibility & Age Requirements

  • The App is intended for users 13 years of age or older.

  • Users under 18 must have verifiable parental or legal guardian consent.

  • By using the App, you represent that you meet these requirements.

We do not knowingly collect personal information from children under 13 without parental consent.

4. Account Registration

  • Users may scan one fish without creating an account.

  • Additional scans require account creation.

  • Registration may be completed via email or supported social login providers.

  • You are responsible for maintaining the confidentiality of your account credentials.

5. Description of the Service

FishScore is a recreational, gamified AR-based fish measurement application that allows users to:

  • Capture images of fish

  • Receive estimated length measurements

  • Generate a FishScore

  • Participate in informal leaderboards and challenges

FishScore does not require physical measuring devices such as bump boards, brag mats, or measuring tapes.

6. Measurement Accuracy Disclaimer

FishScore measurements are generated using computer vision and artificial intelligence.

  • Measurements are estimates, not guarantees.

  • Typical accuracy falls within a ±1 cm tolerance window, but results may fall outside this range.

  • Measurements may be affected by image quality, fish positioning, lighting, motion, and other environmental factors.

IMPORTANT LEGAL NOTICE:

FishScore measurements:

  • Are not certified

  • Are not legally compliant

  • Are not approved for regulatory, record, or enforcement purposes

FishScore must not be used as a substitute for official measurement methods required by:

  • Local, state, federal, or international fishing regulations

  • Tournament rules

  • Record submissions

  • Conservation or compliance determinations

AiAngler Tek, Inc. assumes no liability for reliance on FishScore measurements for legal or regulatory decisions.

7. Recreational & Competitive Features

  • FishScore is designed for recreational and informal competition only.

  • Leaderboards may be weekly or monthly.

  • No prizes or monetary rewards are currently offered.

  • Prizes or rewards may be introduced in the future, subject to additional rules.

Participation is voluntary and for entertainment purposes.

8. User Content & Ownership Ownership

You retain ownership of any photos or content you submit (“User Content”).

License Grant

By submitting User Content, you grant AiAngler Tek, Inc. a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to:

  • Store, host, and display content

  • Analyze and process content using AI systems

  • Modify content for technical processing

  • Train and improve AI and machine learning models

  • Use content for marketing and promotional purposes

  • Share content (including aggregated or de-identified data) with:

    • Government agencies

    • Fisheries management authorities

    • Research institutions

    • Conservation organizations

  • Create anonymized or aggregated datasets for scientific, analytical, or commercial use

This license survives account deletion to the extent required for lawful use, research integrity, and regulatory compliance.

9. Content Deletion

Users may delete their content through the App where functionality is provided.

Deleted content may persist in backups or research datasets where:

  • Required by law

  • Already anonymized or aggregated

  • Necessary for scientific integrity or audit purposes

10. Ads & Subscriptions Free Use

  • FishScore is free to download and includes advertisements.

Subscriptions

  • Optional auto-renewing subscriptions are available (weekly and yearly).

  • Subscription pricing is disclosed in-app.

  • Subscriptions renew automatically unless canceled through the App Store or Google Play.

  • Refunds are governed by Apple or Google’s policies.

11. Prohibited Conduct

You agree not to:

  • Manipulate or falsify images

  • Submit non-fish images

  • Attempt to exploit scoring systems

  • Reverse engineer or interfere with the App

  • Use the App for regulatory disputes or enforcement challenges

12. Safety & Assumption of Risk

Fishing involves inherent risks including injury, water hazards, and equipment damage.

You acknowledge that:

  • You are responsible for your safety

  • You assume all risks associated with fishing activities

  • AiAngler Tek, Inc. is not responsible for injuries, losses, or damages arising from App use

13. Compliance With Laws

You are solely responsible for complying with:

  • Local, state, federal, and international fishing laws

  • Species regulations

  • Size limits

  • Catch-and-release rules

FishScore provides no legal guidance or enforcement validation.

14. Analytics & Device Data

We may collect:

  • Device identifiers

  • Usage analytics

  • Crash logs

  • Performance metrics

This data is used to improve stability, performance, and user experience.

15. Termination

We may suspend or terminate access to the App at our discretion for violations of these Terms.

16. Disclaimer of Warranties

The App is provided “AS IS” and “AS AVAILABLE.”

We make no warranties regarding:

  • Accuracy

  • Availability

  • Fitness for a particular purpose

  • Uninterrupted operation

17. Limitation of Liability

To the fullest extent permitted by law, AiAngler Tek, Inc. shall not be liable for:

  • Indirect or consequential damages

  • Loss of data

  • Measurement inaccuracies

  • Legal or regulatory consequences

  • Personal injury or property damage

18. Arbitration & Class Action Waiver Arbitration

Any dispute arising from these Terms shall be resolved through binding arbitration, except where prohibited by law.

Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in a class, collective, or representative action.

19. Governing Law

These Terms are governed by the laws of the State of Montana, United States, without regard to conflict-of-law principles.

20. Changes to Terms

We may update these Terms periodically. Continued use of the App constitutes acceptance of the updated Terms.
